About Baby Nidan

Baby Nidan is a technology enablement and facilitation platform designed to provide digital infrastructure, pregnancy and child-health tracking tools, automated reminder systems, specialist discovery, scheduling coordination, and consultation facilitation for expectant mothers, new parents, and independent medical professionals including paediatricians and gynaecologists. The platform does not itself render medical diagnoses, clinical prescriptions, treatment protocols, or guarantees of health outcomes. All consultations, communications, medical interpretations, and clinical guidance are provided solely by independent licensed doctors and specialists operating through or invited onto the platform.

Acceptance of Terms

These Terms govern the access and use of the Baby Nidan platform and application. By registering, accessing, or using any service or feature, the user (patient/parent) and the doctor/specialist (medical professional) acknowledge that they have read, understood, and agreed to be legally bound by these Terms, applicable policies, and all prevailing laws of India, including but not limited to the Information Technology Act, 2000 and applicable Health Data Protection regulations.

Baby Nidan operates strictly as a neutral technology facilitator and health information management platform. Any consultation, engagement, transaction, clinical interpretation, or reliance placed upon guidance offered by a doctor through the platform is undertaken at the sole discretion, judgment, and risk of the user.

Nature of Service

Baby Nidan provides tracking tools, automated milestone and vaccine schedule reminders, and a secure channel through which users may send text messages, voice recordings, images, and video to their chosen doctors. The platform enables asynchronous, non-real-time communication between patients and doctors. It is not an emergency medical service, tele-medicine call centre, or diagnostic facility, and must not be used as a substitute for immediate in-person clinical care.

In any medical emergency, users must immediately contact their nearest emergency services, hospital, or dial 112.

Doctor Onboarding & Independence

Doctors who register on Baby Nidan do so as independent medical professionals. The platform verifies submitted credentials for registration purposes only and does not employ, supervise, or direct the clinical decisions or advice provided by any doctor. Baby Nidan does not guarantee the accuracy, completeness, or appropriateness of any medical guidance provided through the platform.

Users who invite their own treating doctors onto the platform acknowledge that Baby Nidan has no supervisory or liability relationship with such doctors.

Limitation of Liability

In the event of any dissatisfaction, disagreement, dispute, or claim arising between a user and a doctor, such matters shall be resolved independently between the concerned parties. While the platform may, at its discretion, review repeated complaints and take administrative actions including suspension or removal of a doctor's profile, it bears no legal, clinical, or financial liability for the outcome of any consultation or medical advice.

Baby Nidan shall not be held liable for any direct, indirect, incidental, consequential, or special damages arising from the use of the platform, including but not limited to reliance on medical guidance, delayed responses, technical outages, or communication failures.

Data Processing & Third-Party Engagement

For operational continuity, service optimization, compliance obligations, regulatory reporting, and enhancement of user experience, certain information may be processed, stored, or transmitted through contractually bound entities including but not limited to cloud infrastructure providers, mobile notification delivery systems, analytics processors, payment intermediaries, communication infrastructure providers, and affiliated corporate entities operating under common management or control, subject always to lawful purpose and confidentiality obligations consistent with applicable Indian law.

Communication Recording & Quality Assurance

Users and doctors acknowledge that interactions conducted via the Baby Nidan platform, including voice messages, images, videos, textual exchanges, and asynchronous communications, may be subject to technical capture or logging for purposes that include system integrity verification, service quality assessment, internal evaluation, compliance monitoring, dispute resolution, and future service refinement. Such records are retained only for limited durations and accessed strictly on a need-to-know basis by authorized personnel.

Subscription & Payments

Core features including pregnancy and baby growth tracking, vaccine schedule generation, and basic reminder delivery are available free of charge. Advanced features, including unlimited on-demand specialist consultations and priority reminder channels, require a paid subscription. Subscription billing, renewal cycles, and cancellation are governed by and processed through the Apple App Store or Google Play Store, as applicable. Baby Nidan does not directly handle payment card information.

Acceptable Use

Users agree to use the platform lawfully, in good faith, and to provide accurate information regarding themselves, their pregnancy, and their child. The platform must not be used to transmit false, misleading, defamatory, or illegal content, or for any purpose other than legitimate healthcare facilitation.

Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts located in the Ambernath–Kalyan jurisdiction, District Thane, Maharashtra, India. By using the platform, all users and doctors expressly submit to this jurisdiction and waive any objection to proceedings in such courts on grounds of venue, inconvenience, or otherwise.

Modifications

Baby Nidan reserves the right to amend these Terms at any time. Continued use of the platform following notification of material changes constitutes binding acceptance of the revised Terms.
